Power of Attorney in Nepal: Types, Process & How to Get It Notarized

A complete guide to power of attorney in Nepal — types (general & special), drafting process, notarization requirements, and how NRNs can authorize POA remotely.

Introduction

A Power of Attorney (POA) is one of the most commonly used legal instruments in Nepal. It allows an individual (the principal) to authorize another person (the agent or attorney-in-fact) to act on their behalf in legal, financial, property, or business matters.

This guide covers the types of POA available in Nepal, the drafting and notarization process, common use cases, and how Non-Resident Nepalis (NRNs) can execute POA remotely.

Types of Power of Attorney in Nepal

General Power of Attorney (GPA): Grants broad authority to the agent to act on behalf of the principal in multiple matters — managing property, handling banking, signing contracts, and representing in legal proceedings. A GPA remains valid until revoked or until the principal's death.

Special Power of Attorney (SPA): Grants limited authority for a specific task or transaction — selling a particular property, withdrawing from a specific bank account, or representing in a specific court case. An SPA expires once the specified task is completed.

Common types include: Property Management POA, Banking POA, Vehicle Transfer POA, Court Representation POA, Business Management POA, and NRN POA (for Nepalis living abroad).

Legal Requirements for POA in Nepal

Under Nepali law, a valid power of attorney must: clearly identify the principal and the agent with full names, addresses, and citizenship/passport numbers; specify the scope of authority in precise terms; be signed by the principal in the presence of a licensed notary public; carry the notary's seal, signature, and registration number; and be registered in the notary's official register.

For property-related POA, the document may additionally need to be registered with the Land Revenue Office (Malpot) or the District Administration Office depending on the nature of the transaction.

POA Drafting & Notarization Process

Step 1: Consult a legal professional to determine the type of POA you need and the specific powers to be granted.

Step 2: Gather required documents — citizenship certificates of both principal and agent, passport (for NRNs), property documents (for property POA), and any relevant supporting documents.

Step 3: The legal team drafts the POA document with precise language specifying the scope, limitations, and duration of authority.

Step 4: The principal signs the POA in the presence of the notary public, who verifies identity, administers the oath, and attests the document.

Step 5: The notarized POA is ready for use. For international use, additional steps like ministry attestation and embassy legalization may be required.

POA for Non-Resident Nepalis (NRNs)

NRNs who cannot visit Nepal in person can initiate the POA process remotely by sharing documents and requirements online. However, the execution (signing before a notary) may require either: visiting a Nepali embassy/consulate abroad for notarization, or having the document notarized locally and then legalized through the embassy chain.

NotaryIn specializes in NRN POA processing. We draft the document based on your requirements, coordinate with the agent in Nepal for any in-person formalities, and ensure the document meets all legal requirements for its intended purpose.

Revoking a Power of Attorney

A POA can be revoked by the principal at any time by issuing a written revocation notice, getting it notarized, and informing the agent and any relevant third parties (banks, land offices). The revocation should be registered with the same notary who attested the original POA.

A POA is automatically revoked upon the death of the principal, mental incapacity of the principal (unless it is a durable POA), completion of the specified task (for SPA), or expiry of the specified duration.
