Affidavit Notarization in Nepal: When You Need It & How to Get One

Learn what an affidavit is, when you need one in Nepal, how to get it drafted and notarized, and the legal weight it carries in courts and official proceedings.

Introduction

An affidavit is a written statement of facts made voluntarily and confirmed by oath or affirmation before a licensed notary public or other authorized officer. In Nepal, affidavits are widely used in legal, administrative, and personal matters as sworn evidence of facts.

This guide explains what an affidavit is, when you need one, the drafting and notarization process, and the legal implications of making a false affidavit in Nepal.

What is an Affidavit?

An affidavit is a legal document in which the person making the statement (the deponent) swears or affirms that the facts stated are true to the best of their knowledge. The deponent signs the affidavit in the presence of a notary public, who administers the oath, verifies the deponent's identity, and attests the document.

Unlike a simple written statement, an affidavit carries legal weight because the deponent is making a sworn declaration. Making a false statement in an affidavit constitutes perjury under Nepali law, which is a criminal offence.

When Do You Need an Affidavit?

Name Change Declaration: When officially changing your name and need to declare the old and new names for government records, passports, and bank accounts.

Marital Status Declaration: Declaring single, married, divorced, or widowed status for visa applications, court marriages, or immigration purposes.

Address Verification: Confirming your residential address when other proof is unavailable.

Income & Financial Declarations: Declaring income, assets, or liabilities for loan applications, visa submissions, or court proceedings.

Lost Document Declaration: Sworn statement that a specific document (citizenship, passport, academic certificate) has been lost, required for obtaining duplicates.

Guardianship & Custody: Declaring guardianship of a minor for travel, education, or medical purposes.

Court Submissions: Providing sworn evidence in civil or criminal proceedings.

Business & Employment: Employee verification affidavits, business closure declarations, partnership dissolution statements.

How to Get an Affidavit Notarized

Step 1: Determine the purpose and content of your affidavit. If you are unsure about the required format, consult a legal professional.

Step 2: Our legal team drafts the affidavit based on your requirements, using the precise language and format required by the intended recipient (court, embassy, government office, or bank).

Step 3: Review the draft and confirm all facts are accurate. Any inaccuracy can have legal consequences.

Step 4: Visit our office with your citizenship certificate or passport for identity verification.

Step 5: The notary public administers the oath, you sign the affidavit, and the notary attests it with their official seal, signature, and registration number.

Step 6: The notarized affidavit is ready for submission. We provide both physical and certified PDF copies.

Legal Implications of False Affidavits

Under the National Penal Code, 2074, making a false statement under oath (perjury) is a criminal offence punishable by imprisonment up to three years and/or a fine. Courts can also impose additional penalties if the false affidavit was used to obtain unlawful benefits, defraud third parties, or obstruct justice.

It is therefore essential that every fact stated in an affidavit is truthful and verifiable. If you are unsure about any detail, state it with an appropriate qualifier ("to the best of my knowledge") rather than making an absolute declaration.
